As you know, as of May 19, the Governor lifted the sector rules imposed in response to the COVI-19 pandemic and has directed that the State will follow the updated CDC mask guidelines, which eliminate most mask wearing requirements – indoor and outdoor – for those individuals who have been fully vaccinated. Notable exceptions are public transportation, schools, healthcare, and assisted living facilities. The updated guidance does not preclude businesses from continuing to require masks for their employees, visitors, and/or customers.

There are still a lot of unanswered questions about how employers will respond to this loosening of requirements, now that the decisions on how to best proceed will fall to them. There is also uncertainly regarding potential liability for those decisions. There is no one-size-fits all here.
